1. | Payment must be made in cash, good check with proper ID, Mastercard or Visa.
Buyer agrees to not stop payment or dispute payment by check or credit card. |
2. | Payment in full is required at the conclusion of the auction. |
3. | Standard 10% Buyer's Premium will be added to the cost of each item sold as part of the purchase price. Bob Johnson Auction & Realty, Inc. is required by state law to collect tax on the entire amount. |
4. | A copy of Resale Tax License is required for tax exempt purchases. Buyer agrees
to indemnify Bob Johnson Auction & Realty, Inc. against any claim if sales tax
is not collected on Buyer's purchases. |
5. | Appropriate sales tax will be collected on all purchases that are not tax exempt. |
6. | Everything is sold AS IS WHERE IS. Merchandise is open to thorough public inspection and it is the Buyer's responsibility to determine age, condition, genuineness and value. Bob Johnson Auction & Realty, Inc. will in no way be held responsible for having made or implied any warranty or use for any particular purpose. |
7. | Nothing shall be removed until settled for. |
8. | Removal shall be at expense, liability, and risk of purchaser. |
9. | Merchandise must be removed day of auction. |
10. | Bob Johnson Auction &Realty, Inc. is not responsible for fire, theft or accidents
of any kind. All persons attending preview, auction or removal of goods assume all risks of damage or loss to person and property and specifically release and indemnify Bob Johnson Auction & Realty, Inc. and/or agents from liability. |
11. | Bob Johnson Auction & Realty, Inc. is not responsible for MERCHANDISE
AFTER SOLD. |
12. | ALL SALES ARE FINAL - NO REFUNDS, EXCHANGES OR REFUSALS.
NO ITEMS WILL BE RESOLD. |
13. | Announcements made the day of auction take precedence over all printed
or oral notices. |
14. | Bob Johnson Auction & Realty, Inc. may withdraw any item before or during
the auction process. |
15. | Title passes to Buyer only when Buyer's payment has cleared. |
16. | Bob Johnson Auction & Realty, Inc. may make execution bids for responsible
parties in their absence but in no case shall be responsible for failure to do so. |
17. | Should a tie or dispute arise between two Buyers, the auctioneer may, at his
sole discretion, reopen the bidding. The record of Bob Johnson Auction &
Realty shall be final. |
18. | Bob Johnson Auction & Realty, Inc. reserves the right to bid on behalf of the
owner of merchandise that has a reserve price. |
19. | The auctioneer shall advance the bidding at his own discretion. |
20. | Employees may bid on merchandise. |
21. | Buyer agrees that these terms shall be governed by the laws of the State of
Colorado and grants sole jurisdiction to the courts in Weld County, CO.
If a dispute arises between Bob Johnson Auction & Realty, Inc. and Buyer,
Buyer waives any right to a trial or hearing in court of law and agrees to settle
the dispute through binding arbitration in Weld County, CO. |
